Scope

These Terms of Service apply to the services provided through the Wisribe – Voice Recorder mobile application (the “App”).

Please read these Terms of Service carefully before using the App.

1. Acceptance

By using the App, you acknowledge that you have read these Terms of Service and agree to them to the extent permitted by applicable law. If you do not agree to these Terms, you should not use the App.

Nothing in this section limits or excludes any mandatory consumer rights or other legal rights you may have under applicable law.

2. Description of the Service

Wisribe – Voice Recorder is an audio recording application that allows you to record audio, use the Silence Filter feature while recording, import audio or video files stored on your device into the App, and apply the Silence Filter to those files directly on your device. The App also allows you to add text or voice notes to recordings and organize recordings into groups.

The Silence Filter uses Voice Activity Detection (VAD) technology to detect silent portions of an audio recording and remove them from a newly created recording. As a result, the duration of the new recording may be shorter. The original recording is preserved, and a separate audio file is created as the output. The results of silence detection and removal may vary depending on audio quality, background noise, and other technical conditions.

Audio recording and Silence Filter processing are performed directly on your device. Audio and video content is not sent to our servers during these processes. However, certain technical or user information may be processed for purposes such as operating the App, managing accounts and subscriptions, analyzing usage, and identifying technical issues. The App offers a free version that includes advertisements, as well as paid subscription options. Creating an account is optional when using the free version. You must create an account and sign in to access paid subscription features.

Features offered through Wisribe may be updated, modified, expanded, or discontinued for reasons such as security, technical requirements, service improvement, or other legitimate purposes. Any such changes will not override your rights under applicable law or any applicable notification requirements.

3. Account Creation

You are not required to create an account to use the free features of Wisribe – Voice Recorder. However, you must create an account and sign in to access paid subscription features.

If you choose to create an account, you are responsible for ensuring that the information you provide during registration is accurate and up to date. You should keep your account authentication credentials secure and contact us without undue delay if you believe your account has been accessed or used without authorization.

Your responsibility for activities carried out through your account will be assessed in accordance with applicable law and the circumstances of the case. This section does not automatically make you liable for unauthorized activities or limit any legal rights you may have.

4. Acceptable Use

When using the App, you agree to comply with the following rules:

• Do not use the App for any purpose that violates applicable law.
• When recording audio, importing audio or video files, or processing such files, obtain any necessary permissions and comply with applicable laws concerning recording, listening, privacy, and personal data protection.
• Do not use another person's account without authorization or attempt to gain unauthorized access to another person's account.
• Do not attempt to interfere with, damage, disrupt, or compromise the security of the App.
• Do not use automated access methods, bots, or similar tools to misuse the App, its infrastructure, or related systems.
• Do not copy the App or related software, attempt to obtain their source code through reverse engineering, or create derivative works, except where such activities are permitted by applicable law.
• Do not use the App to violate the rights of others, make unlawful recordings, or use recordings for unlawful purposes.
• Do not engage in any activity that could compromise the security or integrity of the App or adversely affect other users' ability to use the service.

You are responsible for ensuring that the content you record or import into the App is lawful, that you have the rights and permissions necessary to record and use that content, and that you process it in accordance with your intended purpose and applicable law. This responsibility does not relieve the provider of the App of any obligations it may have under applicable law.

If there are reasonable grounds to believe that these Terms of Service or applicable law have been violated, appropriate and proportionate measures may be taken based on the nature and severity of the violation. Such measures may include restricting access to certain features, temporarily suspending an account, or closing an account where permitted by these Terms and applicable law. Where necessary and legally required, we may cooperate with the relevant authorities.

5. Subscriptions and Payments

Wisribe – Voice Recorder offers a free version and may also offer paid subscription plans. Advertisements are displayed when using the free version. The features included in each paid subscription are described in the relevant subscription plan and within the App.

Paid subscriptions are charged according to the plan and subscription period you select. Unless otherwise stated at the time of purchase, subscriptions may automatically renew in accordance with the terms and policies of the app store through which the subscription was purchased (Google Play or the Apple App Store).

Purchasing, managing, renewing, and canceling a subscription are handled through the relevant account settings of the app store used to make the purchase. Unless otherwise required by applicable law or the app store's policies, canceling a subscription does not prevent you from continuing to access the subscription benefits until the end of the current paid subscription period. Cancellation does not automatically entitle you to a refund for the current subscription period.

Subscription prices, taxes, currencies, payment methods, and other payment terms may vary depending on your country, the app store, the plan you select, and applicable law. The prices and terms presented to you at the time of purchase will apply to that transaction.

Refund requests, cancellation rights, and other post-purchase matters are subject to the policies of the app store through which the purchase was made and applicable law. Nothing in this section limits any statutory right of withdrawal, refund right, or other mandatory consumer right you may have.

You must create an account and sign in to the App to access paid subscription features.

6. Usage Limits

Certain features of Wisribe – Voice Recorder may be subject to usage limits under the free version or access conditions associated with paid subscription plans. Applicable limits and feature access conditions are described within the App or in the relevant subscription plan.

The features available in the free version, the display of advertisements, and the features included in paid subscriptions may differ. You are responsible for reviewing the scope and terms of the relevant plan before purchasing a paid subscription.

Wisribe may modify usage limits to prevent misuse, maintain the security and stability of the App, or address technical and operational requirements. Where reasonably practicable, such changes will be communicated in advance and implemented in accordance with applicable law. Changes will not be applied in a way that violates rights associated with existing subscriptions or mandatory consumer rights.

7. Intellectual Property

Unless otherwise stated, all intellectual property rights in the Wisribe – Voice Recorder App and the software, design, user interface, logos, trademarks, text, graphics, and other elements provided through the App belong to Wisribe or their respective rights holders and are protected by applicable law.

These Terms of Service grant you a limited, non-exclusive, non-transferable, and revocable license to use the App for personal and lawful purposes. This license is subject to any mandatory rights you may have under applicable law. No intellectual property rights in the App or any of its components are transferred to you under these Terms.

8. User Content

Any audio recordings you create or import through the App, audio recordings generated as a result of the Silence Filter, voice notes, text notes, and other content (collectively, “User Content”) remain the property of you or the relevant rights holder, subject to applicable law and any rights of third parties.

Audio recordings created using Wisribe – Voice Recorder, recordings generated by applying the Silence Filter, and voice notes are stored in a storage location on your device that is used by the App and accessible to you. Text notes are stored within the App. These contents are not uploaded to or stored on our own servers for the purpose of operating the App’s core recording and Silence Filter features.

Your use of the App does not transfer ownership of, or any intellectual property rights in, User Content to Wisribe. You are responsible for ensuring that your User Content is lawful, that you have the rights and permissions necessary to record, import, and use it, and that you respect the intellectual property, privacy, and other rights of third parties.

If you copy, move, share, or export User Content from the App’s storage location to another location, those actions and any subsequent use of the content are under your control. You must comply with applicable law and respect the rights of the relevant individuals when carrying out these actions.

9. Limitation of Liability

Wisribe – Voice Recorder provides features such as audio recording, the Silence Filter (based on Voice Activity Detection, or VAD), adding voice notes, creating text notes, and organizing recordings into groups. The App’s performance may vary depending on your device’s hardware, operating system, microphone and other permissions, available storage space, audio source, and other technical conditions. We do not guarantee that the App will operate continuously or without errors on all devices.

The Silence Filter automatically detects silent portions of an audio recording and removes them from a newly created recording. Due to audio quality, background noise, speaking patterns, and other technical factors, some audio segments may be incorrectly classified as silent and may not be included in the resulting recording. As a result, the entire audio content you expect to retain may not be preserved in the filtered output. Although the original recording is preserved, we recommend reviewing the newly created recording before using it.

Audio recordings created through the App, recordings generated by the Silence Filter, and voice notes are stored on your device, while text notes are stored in the App’s own database. Content may be lost or become inaccessible due to device failure, operating system issues, uninstallation of the App, data deletion, storage damage, or other actions taken by you. Unless a separate backup service is expressly stated to be provided, the App’s features should not be considered an independent backup service.

Wisribe provides the App “as is” and “as available.” To the extent permitted by applicable law, liability for indirect or consequential damages arising from the use of, or inability to use, the App may be limited. However, this provision does not apply to cases involving intent, gross negligence, or any other circumstances in which liability cannot be limited under applicable law.

This section does not exclude or restrict any mandatory consumer rights or any other rights or liabilities that cannot be excluded or limited under applicable law.

10. Termination

If these Terms of Service are violated, the App is used unlawfully or misused, or circumstances arise that threaten the security or operation of the App, Wisribe may take necessary and proportionate measures based on the nature and severity of the violation. Such measures may include restricting access to certain features, temporarily suspending an account, or closing an account where permitted by applicable law.

Where required by applicable law, we may cooperate with the relevant competent public authorities.

If you have an account, you may request its closure through the App or by contacting us. Since creating an account is not required to use the free features, users who use the App without creating an account are not subject to the account-closure provisions of this section.

Closing your account may not automatically cancel a subscription purchased through an app store. You must cancel your subscription separately through Google Play or the Apple App Store, as applicable, depending on where you made the purchase. Closing your account does not eliminate any information that must be retained under applicable law or any payment obligations that have already arisen.

Audio recordings stored on your device, recordings created using the Silence Filter, voice notes, and text notes stored in the App’s own database are treated separately from account closure. Closing your account does not mean that these contents will automatically be deleted. Their deletion depends on how the App operates and on the actions you take.

11. Governing Law and Dispute Resolution

To the extent permitted by applicable law, these Terms of Service shall be governed by and interpreted in accordance with the laws of the Republic of Türkiye.

The parties agree to make reasonable efforts to resolve any disputes arising out of or in connection with these Terms of Service in good faith and through mutual communication in the first instance.

If a dispute cannot be resolved amicably, the competent courts and authorities shall be determined in accordance with applicable law. Nothing in this provision excludes or restricts any mandatory consumer rights or other legal rights that users may have in their country of residence and that cannot be limited by contract.

12. Changes to These Terms of Service

Wisribe may update these Terms of Service from time to time. Such changes may result from updates to the App’s features, changes in how services are provided, security requirements, or changes in applicable law.

Material changes will be communicated, where appropriate, through in-app notifications or other reasonable means of communication. The effective date of any changes will be communicated to users where required.

Where additional consent is required for the updated Terms to be accepted or take effect, that consent will be obtained in accordance with applicable law. This section does not restrict any rights arising from users’ existing subscriptions or any mandatory rights they may have under applicable law.
