Scope

These Terms of Service apply to all services provided through the Wisribe mobile application (the "Application") and the Wisribe website (the "Website").

Please read these Terms of Service carefully before using the Application or the Website.

1. Acceptance

By accessing or using the Application or the Website, you agree to be bound by these Terms of Service and to comply with them. If you do not agree to these Terms of Service, you must not access or use the Application or the Website.

2. Description of the Service

Wisribe is an application that provides audio processing services, including the processing and transcription of audio recordings and audio or video files provided by users, AI-powered content generation and analysis, document creation, and other productivity and audio processing features.

The features and services provided by Wisribe may be updated, modified, expanded with new features, or discontinued at any time, with or without prior notice, for the purpose of improving the Service. Such changes do not affect any legal rights you may have under applicable law.

3. Account Registration

To use the Services provided by Wisribe, you must create a user account.

You are responsible for ensuring that the information you provide during account registration is accurate, current, and complete. You are also responsible for maintaining the confidentiality of your account credentials and login information.

To the extent permitted by applicable law, you may be held responsible for activities carried out through your account. If you believe that your account has been accessed without authorization or that its security has been compromised, you must notify us without undue delay.

4. Acceptable Use

By using the Application or the Website, you agree to comply with the following rules:

• You must not use the Application for any unlawful purpose or in violation of applicable laws or regulations.
• You must obtain all necessary permissions before processing audio recordings, images, or other content, and you must respect the privacy and other rights of third parties.
• You must not use another person's account without authorization or attempt to gain unauthorized access to another user's account.
• You must not interfere with, damage, disrupt, or compromise the operation or security of the Application, the Website, or the Services.
• You must not misuse the Services by using automated systems, bots, or similar methods that impose an unreasonable or excessive load on our systems.
• You must not reverse engineer, decompile, disassemble, copy, attempt to obtain the source code of, or create derivative works based on the Application, the Website, or any related software, except as permitted by applicable law.
• You must not use AI-generated content for unlawful, misleading, or rights-infringing purposes.

If you violate these Terms of Service, Wisribe reserves the right to temporarily suspend your account, restrict access to certain features, or permanently terminate your account. Where required or permitted by applicable law, Wisribe may also cooperate with competent authorities.

5. Subscriptions and Payments

Wisribe may offer both free features and paid subscription plans.

Paid subscriptions are billed according to the subscription plan and billing period you select. Unless otherwise expressly stated, subscriptions automatically renew in accordance with the policies of the application store through which the subscription was purchased (such as Google Play or the Apple App Store).

Subscription management, renewal, and cancellation are handled through the account settings of the application store where you purchased your subscription. Cancelling a subscription does not affect your ability to continue using its benefits until the end of the current billing period.

Subscription fees, taxes, currency, and payment terms may vary depending on your country or region, the application store, and applicable laws.

6. Usage Limits

Certain features of the Services may be subject to usage limits, including processing time, usage allowances, AI credits, or similar usage restrictions. The applicable limits are specified in the relevant subscription plan or within the Application.

Unless otherwise expressly stated, any unused processing time, AI credits, or other usage allowances will not carry over to the next subscription period.

Wisribe reserves the right to make reasonable changes to usage limits in order to prevent abuse, maintain the quality of the Services, or address technical or operational requirements. Any such changes will be implemented in accordance with applicable laws.

7. Intellectual Property

Unless otherwise stated, all intellectual property rights in and to Wisribe, the Application, the Website, and all software, designs, user interfaces, logos, trademarks, text, graphics, images, and other content made available through them are owned by Wisribe or the respective rights holders and are protected under applicable intellectual property laws.

Subject to these Terms of Service, you are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the Application and the Website solely for your personal and lawful use. These Terms of Service do not grant or transfer any intellectual property rights to you.

8. User Content

Unless otherwise stated, audio recordings, audio and video files, transcripts, AI-generated content, documents, and any other content that you create through or upload to the Application (collectively, "User Content") remain your property.

By using the Application, you grant Wisribe the right to process your User Content to the extent necessary to provide, maintain, improve, and operate the Services, and to perform the processing activities you request.

When uploading or creating User Content through the Application, you represent and warrant that you have all necessary rights to such User Content and that it does not infringe the intellectual property rights, privacy rights, or any other rights of any third party.

9. Limitation of Liability

Transcripts, summaries, analyses, and other AI-generated content provided through Wisribe are generated automatically. Accordingly, Wisribe does not guarantee the accuracy, completeness, timeliness, or fitness for a particular purpose of such content.

The accuracy of transcripts, summaries, analyses, and other AI-generated content may be affected by factors such as audio quality, background noise, the number of speakers, speaking style, accent, recording conditions, and other technical factors. You acknowledge that the quality of the audio or video recordings you submit to the Application may affect the results produced by the Services. Wisribe shall not be liable for any inaccurate, incomplete, or unexpected results arising from such technical factors.

You are solely responsible for deciding how to use the content generated by the Application and, where appropriate, for independently verifying its accuracy before relying on it.

The Application, the Website, and the Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, Wisribe shall not be liable for any loss of data, loss of business, loss of revenue, loss of profits, or any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Application, the Website, or the Services.

Nothing in these Terms of Service limits or excludes any rights or liabilities that cannot be limited or excluded under applicable law.

10. Termination

Wisribe reserves the right to temporarily suspend your account, restrict access to certain features, or permanently terminate your account if you violate these Terms of Service, use the Application or the Website unlawfully or abusively, infringe the rights of other users or third parties, or create security risks.

Where required or permitted by applicable law, Wisribe may cooperate with competent governmental or regulatory authorities.

You may close your account at any time through the Application or by contacting us. Closing your account does not affect any obligations relating to subscriptions, payments, or the retention of data where required under applicable law.

11. Governing Law and Dispute Resolution

These Terms of Service shall be governed by and construed in accordance with the laws of the Republic of Türkiye, without regard to its conflict of laws principles.

The parties agree to make a good-faith effort to resolve any dispute arising out of or relating to these Terms of Service through amicable discussions before initiating legal proceedings. If such a dispute cannot be resolved, the courts and enforcement offices of the Republic of Türkiye shall have jurisdiction, subject to any mandatory provisions of applicable law.

Nothing in this section affects any mandatory consumer rights or other legal rights that cannot be waived or limited under the applicable laws of your country or region of residence.

12. Changes to These Terms of Service

Wisribe may update these Terms of Service from time to time. Where appropriate, we will notify users of material changes through in-app notifications, our Website, email, or other appropriate communication methods.

Your continued use of the Application or the Website after the updated Terms of Service become effective constitutes your acceptance of the revised Terms of Service.
